Court of Appeals Denies Dow Corning’s Motion to Stay Partial Premium Payments!

On March 31, 2014, the Court of Appeals DENIED Dow Corning’s Motion to Stay (stop) the Partial Premium Payments from being issued.  This is a victory for claimants!!  It means the Finance Committee can begin sending award letters and checks with partial Premium Payments to Claimants who have already received any settlements from the SF-DCT starting this month.  The Settlement Facility will send out the first batch of award letters and will continue to mail them on a rolling basis until everyone who is eligible for a partial Premium Payment has been notified.  Checks will be mailed approximately two weeks after the award letters are sent.  It will take six months or more to mail all of the letters and checks, so please be patient.

The Award Letters will be sent to you and to us, as your attorneys.  Because this is being done on a rolling basis, some claimants will receive their letter and check before others. Please do not be alarmed if you hear someone else has received their check and you have not.  The Claimant’s Advisory Committee will post when the process is complete. If you haven’t received your check by that time, then you or I can follow-up directly with the Settlement Facility. A copy of the Order is on www.tortcomm.org under “Court Orders” and under “Sixth Circuit Court of Appeals.  Remember, this applies only to those of you who have already received a settlement from the SF-DCT.
